Understanding Ontario Regulation 422/17: A Complete Guide to the OINP

Navigating Canadian immigration rules can be complex for both foreign workers and Canadian employers. If you plan to settle in Ontario or hire foreign talent through the Ontario Immigrant Nominee Program (OINP), Ontario Regulation 422/17 (O. Reg. 422/17) is one of the most important legal frameworks you need to know.

Enacted under the Ontario Immigration Act, 2015, O. Reg. 422/17 outlines the rules, eligibility requirements, and employer standards for provincial economic nomination streams. Here is a comprehensive overview of how this regulation works and what it means for your application.


What is Ontario Regulation 422/17?

Ontario Regulation 422/17 establishes the operational foundation for the OINP. It grants the provincial government the legal authority to nominate individuals for permanent residence based on local economic and labor market needs.

The regulation covers key operational details, including:

  • Specific streams and categories of applicants.

  • Strict requirements that Ontario employers must meet to support a nomination.

  • General eligibility rules for foreign workers, including legal status and intent to reside.

  • Program integrity measures, such as administrative penalties and application bans.


Categories of Applicants

Under O. Reg. 422/17, Ontario categorizes applicants into structured workforce priorities based on the National Occupational Classification (NOC) system:


  1. Ontario Workforce Priority: TEER 0–3 Category: 

    1. Target Audience: High-skilled professionals, managers, technical specialists, and skilled tradespeople.

    2. Job Offer Required: Yes, a valid full-time, permanent (indeterminate) job offer from an eligible Ontario employer in a NOC TEER 0, 1, 2, or 3 occupation.

    3. Education: Minimum of a Canadian post-secondary degree, diploma, or certificate (or foreign equivalent validated by an Educational Credential Assessment).

    4. Language Proficiency: Minimum of Canadian Language Benchmark (CLB) 6 in all four abilities (listening, reading, writing, speaking), though a minimum of CLB 5 applies for specific eligible skilled trades occupations.

    5. Wage Requirements: Position must pay at or above the median wage level for that region and occupation on the Job Bank (or low wage level for recent Ontario graduates).

    6. Work Experience (Option A): 6 months consecutive in the last 12 months in the job offer position with the job offer employer.

    7. Work Experience (Option B): 3 months consecutive in the last 12 months for recent Ontario graduates, same position with the job offer employer.

    8. Work Experience (Option C): 2 years cumulative in the last 5 years in the same NOC occupaton.

    9. Licensed Applicants: Excempt from the work experience requirement.

    10. Language: CLB 6 minimum (CLB 5 for certain occupations).

    11. Education: Post-secondary degree or diploma.


  1. Ontario Workforce Priority: TEER 4–5 Category:

    1. Target Audience: Intermediate, foundational, and essential operational roles in the provincial workforce.

    2. Job Offer Required: Yes, a valid full-time, permanent job offer from an eligible Ontario employer in a NOC TEER 4 or 5 occupation.

    3. Work Experience: Must have at least 9 months of cumulative full-time work experience in Ontario within the past 2 years in the same occupation as the job offer.

    4. Education: Minimum of a Canadian secondary school diploma or foreign equivalent supported by a valid Educational Credential Assessment (ECA).

    5. Language Proficiency: Minimum of Canadian Language Benchmark (CLB) 4 in all four abilities.

    6. Wage Requirements: Must meet or exceed the median wage level for the occupation and region.


  1. Ontario Workforce Priority: Self-Employed Physician Category: 

    1. Target Audience: Qualified medical practitioners setting up or joining a practice in Ontario.

    2. Job Offer Required: No job offer required. This is the only pathway under this stream exempt from the employer job offer requirement.

    3. Professional Credentials: Must hold a valid certificate of registration in good standing with the College of Physicians and Surgeons of Ontario (CPSO) (full or provisional).

    4. OHIP Eligibility: Must be eligible for the Ontario Health Insurance Plan (OHIP) billing framework.

    5. Occupation Scope: Restricted to qualifying general practitioners, family physicians, and specialist physicians (NOC 31100, 31101, or 31102) actively practicing or intending to practice in Ontario.


Strict Requirements for Employers

A major portion of the new OINP program focuses on ensuring that businesses nominating foreign workers are legitimate, financially stable, and providing genuine job opportunities. Under Section 4 of the regulation, employers must meet several core standards:

1. Business History and Physical Location

The employer’s business must have been active and operational for at least three years before applying. Additionally, the business must maintain a physical location in Ontario where the applicant will primarily perform their duties.


2. Gross Annual Revenue Thresholds

To ensure the business can support an additional full-time salary, O. Reg. 422/17 sets tiered revenue requirements based on business location:

  • Greater Toronto Area (GTA): The business must have generated at least $1,000,000 in total gross annual revenue in its most recent fiscal year.

  • Selected Urban Regional Municipalities (e.g., Ottawa, Waterloo, Hamilton, Niagara, Simcoe, Thunder Bay): The business must have generated at least $500,000 in gross annual revenue.

  • All Other Areas of Ontario: The business must have generated at least $250,000 in gross annual revenue in each of the two most recent fiscal years.


3. Minimum Canadian Workforce Requirements

Employers must already employ a baseline number of local workers:

  • Inside the GTA: The business must have at least five full-time employees who are Canadian citizens or permanent residents working at that location.

  • Outside the GTA: The business must have at least three full-time employees who are Canadian citizens or permanent residents working at that location.


4. Job Offer and Wage Requirements

The position offered to the foreign national must be full-time (a minimum of 30 hours per week and 1,560 hours per year) and indeterminate (permanent). Furthermore, the offered wage must equal or exceed the median wage for that occupation and region as listed on the Government of Canada Job Bank. An exception exists for recent Ontario graduates applying in TEER 0–3 roles, who may be offered the entry-level low wage rate.


Candidate Eligibility Criteria

For applicants seeking provincial nomination under the new OINP program, meeting candidate-specific rules is mandatory:

  • Intention to Reside: Applicants must demonstrate a genuine, reasonable intention to live and settle in Ontario.

  • Legal Status in Canada: If applying from inside Canada, the applicant must maintain valid temporary resident status throughout the process.

  • Invitations to Apply (ITA): Candidates must apply within set deadlines after receiving an official invitation through Ontario's Expression of Interest (EOI) or Express Entry selection process.
